CORNELIUS, Chief Justice.

James Stevens appeals from an adverse summary judgment in his suit against State Farm Fire and Casualty Company, Elaine Wourms, Joe Parks, and Robert Dierkes. He contends that the trial court erred in granting the judgment. We reverse the judgment as to State Farm and remand the cause against State Farm for a trial on the merits.
