This case is on appeal to this Court for the second time. Plaintiff, Allie Martin, sustained serious injuries in a single automobile accident on May 10, 1992, on a portion of State Highway 45 known as "Fleming's Curve." The trial court found DOTD 60% at fault and plaintiff 40% at fault.
