This is an appeal from a conviction of assault. Appellant was indicted for aggravated assault upon a police officer under Tex. Penal Code Ann. § 22.02(b)(2)(Vernon 1994). Following a plea of not guilty in a trial on the merits, a jury found appellant guilty of the lesser included offense of assault as defined by TEX.PENAL CODE ANN. § 22.02(a)(1) (Vernon 1994).
