We granted writ of certiorari to determine whether there exists a genuine issue of material fact on the issue of damages under the facts of this medical malpractice case, so as to warrant the granting of a Motion for Summary Judgment. The trial court granted plaintiff's Motion for Summary Judgment on the issue of damages, and awarded to plaintiff the $500,000.00 limit for general damages provided under La.R.S. 40:1299...
