The City of Dallas appeals a judgment entered in favor of Villages of Forest Hills, L.P., Phase I ("Villages") following a bench trial. In two points of error, the City contends the trial judge erred in (1) denying its motion for summary judgment, and (2) awarding judgment in favor of Villages for $360,705 plus interest and attorney's fees.
