DUNCAN, Justice.

Appellant, Reynaldo Irizarry, was charged with and convicted of murder. Punishment was assessed by the jury at ninety-nine years confinement in the Texas Department of Criminal Justice, Institutional Division, and a fine of $10,000. On appeal Irizarry argues that the trial court erred in denying his requested charge on aggravated assault; erred in the application paragraph of the jury charge; erred in denying his motion for new trial...
