Plaintiff Andrew Thomas (Thomas) brought this diversity suit against defendants Bombadier-Rotax Motorenfabrik, GmbH (Rotax) and Decker Aero Power, Inc. (Decker Aero), alleging that defendants were negligent, had breached an implied warranty of safety, and are strictly liable for injuries he sustained when his experimental ultralight aircraft crashed during a test flight.1
