Paul Calcagno appeals from an order of the Garland County Circuit Court dismissing his complaint.1 We find no error and affirm.

Summary judgment under Rule 56 of the Arkansas Rules of Civil Procedure is proper when there is no genuine issue as to a material fact and the moving party is entitled to summary judgment as a matter of law. Skaggs v. Johnson, 323 Ark. 320,
