The district court granted separate motions by respondents Kory Ken Bunde and Jeremy William Francis for dismissal of driving-under-the-influence charges. Each respondent asked for dismissal on the ground that the arresting officer did not have authority to make arrests outside his municipality. On appeal, the State argues that respondent Bunde waived the right to object to the validity of his arrest and that the arresting officer...
