Plaintiffs filed a personal injury suit against the Missouri Pacific Railroad Company, W.A. Mitternight, the Louisiana Department of Transportation and Development, and the Parish of St. Martin. The Parish of St. Martin was dismissed as a party to this suit by the trial court.
