Plaintiff commenced this action pursuant to 42 U.S.C. § 1983 and various state law provisions, alleging the violation of her rights as the result of an arrest by Defendant Officer Mark Spurgeon ("Spurgeon"). Now before the Court is Defendants' September 19, 1996 Motion to Dismiss under Federal Rule of Civil Procedure 12(b)(6).
