BERTELSMAN, Chief Judge:

This matter comes before the court on a motion for judgment as a matter of law, made after a jury verdict for the plaintiff in the total amount of $266,143.00.1

Similar motions were timely made at the conclusion of the plaintiff's trial evidence and at the conclusion of all the evidence.2 The court reserved on the motions at that time.
