Defendant appeals from his conviction of attempted aggravated first degree theft by deception. ORS 164.015; ORS 164.057; ORS 164.085. He assigns error to the denial of his motion for acquittal, made at the end of the prosecution's case, in which he contended that the state had failed to prove that venue was in Multnomah County.
