Richard R. Ryder ("Ryder") instituted this "hybrid action" against his employer and union under Section 301 of the Labor Management Relations Act, 29 U.S.C. § 185. Ryder alleges that Philip Morris, U.S.A. ("Philip Morris") discharged him in violation of a collective bargaining agreement.
