Appellee Sisinia Pro worked in the office of the Clerk of the Orphans' Court, under the general direction of Ronald Donatucci, Register of Wills of Philadelphia County. In October 1993, Donatucci's wife subpoenaed Pro to testify in her divorce action against Donatucci. Pro duly appeared pursuant to the subpoena, but was not called to testify.
