MEMORANDUM OPINION AND ORDER
SOLIS, District Judge.
Presently before this Court are Defendant's Motion to Dismiss or, in the Alternative, for Summary Judgment, filed June 21, 1996; Plaintiffs' Response thereto, filed July 12, 1996; Defendant's Reply Brief, filed July 26, 1996; and Defendant's Supplemental Authority, filed August 1, 1996.
