NORRIS, Judge.

Russel Gatch was charged by bill of information with aggravated oral sexual battery, La.R.S. 14:43.4, for conduct with a seven-year-old boy, "C.M." A six-person jury found Gatch guilty of attempted aggravated sexual battery. The State subsequently billed him as a second felony offender; the district court sentenced him to 7½ years at hard labor without benefit of probation or suspension of sentence.
