Appellant Richard Chalmers was injured in a head-on automobile accident allegedly caused by respondent Robert Kanawyer. Appellant entered into a purported Miller-Shugart agreement with respondent, but the agreement failed to include the owner of the vehicle, who was the named insured under a liability insurance policy covering the car.
