OPINION
HUDSON, Justice.
A jury found appellant, a juvenile, engaged in the delinquent conduct of capital murder. The court committed appellant to the Texas Youth Commission until he reaches the age of seventeen and one half years, and to thereafter be transferred to the Institutional Division of the Texas Department of Criminal Justice to serve the remainder of a forty year sentence.
