Before the Court are Plaintiff's motion for summary judgment on the merits, Defendants' reply thereto, Defendants' Rule 12(b)(1) and Rule 12(b)(5) motions to dismiss, and Plaintiff's reply thereto. (Dkt. Nos. 13, 17, & 19). Because the Court finds merit in Defendants' Rule 12(b)(1) motion asserting that the Court lacks subject-matter jurisdiction over Plaintiff's complaint, the Court does not reach the merits...
