Appellant Leroy Barker was indicted for the offense of indecency with a child. Barker pleaded not guilty to a jury, and, after hearing evidence, the jury found him guilty. Barker elected that the court assess punishment, and the court assessed his punishment at 25 years' confinement in the Institutional Division of the Texas Department of Criminal Justice.
