After finding that the defendant, Thomas Kyle Godfrey, and the deceased, Mrs. Elizabeth Bannerman, were both negligent, a jury found that the negligence or fault of Thomas Kyle Godfrey was not a proximate cause of the injuries which resulted in the death of Mrs. Bannerman.
