The plaintiff Jadwiga Zurowska brought this action alleging an intentional tort by her employer, the defendant Berlin Industries, Inc. She alleged that while she was working, her right hand was caught in a strapping machine. The incident resulted in permanent injury to her right hand and shoulder and severe damage to her nervous system. The defendant moved to dismiss the case because the plaintiff had already filed...
