Plaintiff appeals the sua sponte dismissal of his petition for habeas corpus. We reverse.

Plaintiff was convicted of sexual abuse in the first degree and sodomy in the second degree and sentenced, in July 1993, to a period not to exceed five years on each conviction, to be served consecutive to each other.
