SCHEINDLIN, District Judge.

Defendant Union Local 306 ("Local 306" or "the Union") moves to disqualify Merrick J. Brodsky ("Brodsky") as counsel to Plaintiff Randolph Herr ("Herr"). For the reasons discussed below, the motion is denied.
