Pastor Ortiz-Gonzalbo stands accused of reentering the United States without authorization after having been deported in 1989, in violation of 8 U.S.C. § 1326. His alleged unlawful reentry was detected after his April 1996 arrest and fingerprinting by New York City police officers, and the consequent disclosure that his fingerprints matched those in the file associated with his deportation.
