This case is before this Court1 upon an appeal from the final order of the Circuit Court of Hampshire County, entered on April 5, 1995. The appellant, Patricia Lynn Smith, was convicted by a jury of the offense of murder of the second degree, W. Va.Code, 61-2-1 [1991], and of the offense of conspiracy, W. Va.Code, 61-10-31 [1971].
