The "safety valve" provision of the United States Sentencing Guidelines, U.S.S.G. § 5C1.2, directs the district court to impose a sentence without regard to the statutory mandatory minimum sentence if a defendant satisfies certain criteria. Pedro Ramirez appeals the district court's decision to sentence him to a mandatory minimum sentence of sixty months, based on that court's determination that he did not qualify for the safety valve provision...
