Joel Cavazos, Jr. and Cassandra L. Cavazos, through their mother, Lucille Cavazos, as plaintiff and next friend, brought suit claiming that an addendum (Schedule Five) to the agreement incident to divorce entered into by Joel Sr. and Lucille created a trust in their favor. In response, Joel Cavazos, Sr., appellee, filed a motion for summary judgment arguing that (1) Schedule Five is not part of the agreement or the decree...
