STATON, Judge.

Roy S. Spriggs ("Spriggs") appeals his conviction for operating a vehicle with a blood alcohol content ("BAC") of .10% or more, a class D felony1. He raises two issues on appeal, which we restate:

I. Whether blood alcohol test results should have been excluded from evidence.

II. Whether he received effective assistance of counsel.
