GETTLEMAN, District Judge.

Before the court are two motions to dismiss plaintiff Ricardo Senisais' ("Senisais") complaint. The first is filed on behalf of defendant Dr. Funk ("Funk"), and the second is filed on behalf of defendant Dr. John Duffy ("Duffy")1. For the reasons that follow, the court denies both defendants' motions to dismiss.
