POPEJOY v. STATE

No. 96-906.

678 So.2d 455 (1996)

William S. POPEJOY, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, First District.

Rehearing Denied September 13, 1996.

Attorney(s) appearing for the Case

William S. Popejoy, pro se, appellant.

Robert A. Butterworth, Attorney General, and Giselle Lylen Rivera, Assistant Attorney General, Tallahassee, for appellee.

PER CURIAM.

Upon review of the record, we have determined that the sentencing guidelines scoresheet was incorrectly calculated. Appellant's score produced a permitted range of any non-state prison sanction or community control or 1-3½ years incarceration, instead of the 1-4½ years reflected on the guidelines scoresheet. The cause is REVERSED and REMANDED to the trial court to correct appellant's sentence.
