RULON, J.:

Scott M. Arculeo, defendant, appeals his sentence resulting from his guilty plea to one count of attempted theft, K.S.A. 21-3701 and K.S.A. 21-3301, a level 10, nonperson felony. We affirm.

The facts of this case are not in dispute.
