On order of the Court, the motion for immediate consideration is GRANTED. The application for leave to appeal before decision by the Court of Appeals is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the Court of Appeals order of October 9, 1996, insofar as it granted leave to appeal.
