On order of the Court, the motion for reconsideration of this Court's order of November 14, 1995, is considered, and it is GRANTED. On reconsideration, we VACATE that portion of our order dated November 14, 1995, that denied the application for leave to appeal as cross-appellant. Pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the defendant's conviction and REMAND the case to the Calhoun Circuit Court for a new trial, if the prosecution concludes...
