OPINION

HILL, Justice.

This is an appeal from a summary judgment. We reverse the judgment of the trial court and render in part and remand in part.

Bill Edward Mayes, Jr. was employed by the City of De Leon as its chief of police. On January 20, 1994, the De Leon City Council met. After the council went into executive session, the council reconvened in open session and voted to terminate Mayes' employment. Mayes then sued the City seeking a declaratory...
