Appellant David Alan Starnes was convicted by a jury of the offense of misapplication of fiduciary property as charged in the indictment. His punishment was assessed by the court at ten years' confinement in the Institutional Division of the Texas Department of Criminal Justice. The term was probated, and appellant was placed on probation for ten years. Appellant perfected appeal, and in a single point of error...
