Defendant was indicted and charged with one count of assault in the second degree as the result of an incident that occurred on October 2, 1993 at the Club Elante in the Village of Endicott, Broome County. Following a jury trial, defendant was found guilty as charged and sentenced as a second violent felony offender to an indeterminate term of imprisonment of 3½ to 7 years. Defendant now appeals.
