DUNCAN, Justice.

This Court's opinion issued on January 10, 1996, is withdrawn and this opinion is substituted.

Appellant, Allen Spock Hartman, was convicted of driving while intoxicated. Punishment was assessed at ninety days in jail, probated for two years, and a fine of $300 plus court costs. In eight points of error, Hartman argues the trial court erred in denying his motion to suppress; erred in denying his requested jury instruction...
