OPINION ON REMAND

MORRIS, Justice.

This is an opinion on remand from the Texas Court of Criminal Appeals. The State appealed the trial court's decision to suppress evidence that showed appellee resisted arrest. The trial court suppressed the evidence on the ground that it was "fruit of the poisonous tree" because no arrest warrant existed. We reversed the trial court's decision in State v. Mayorga, 876 S.W.2d 176
