BLEIL, Justice.

Burlington Northern Railroad Company (Burlington) appeals a judgment entered in favor of Southwestern Electric Power Company (SWEPCO) following a jury trial. Burlington challenges the trial court's submission of certain jury questions, entry of a declaratory judgment, and award of attorney's fees. SWEPCO raises two conditional cross-points of error challenging certain evidentiary rulings made by the trial court for our consideration...
