KAUFMAN, Senior District Judge.

(1) Reference is hereby made to defendants' motions to dismiss and to all other filings in this case. For the foregoing reasons, defendants' motions to dismiss are denied.

(2) Plaintiff, the United States of America, filed a complaint on behalf of Mr. Gilmore Thompson, ("Thompson"), a black male, pursuant to § 812(o) of the Fair Housing Act ("FHA").1
