The plaintiff, Samuel Donald Hood II (Hood II), was the administrator of his mother's estate. In that capacity, he brought a wrongful death action, which was settled. The heirs of the estate, including plaintiff's father, defendant Samuel Donald Hood (Hood), claimed that Hood II never properly distributed the proceeds of the settlement to the heirs.
