This case comes before the Court on Defendant's motion for judgment on the pleadings. The facts, as stated in Plaintiff's complaint, are as follows: on April 14, 1991, Karl Clark, a resident of North Carolina, drowned in a swimming pool at a hotel in Spartanburg, South Carolina.
