Pursuant to a plea of no contest, Gary McMann was convicted of criminal attempt, a violation of Neb.Rev.Stat. § 28-201(1)(b) (Reissue 1989), a Class I misdemeanor. In a memorandum opinion of this court dated November 21, 1994, McMann's sentence was vacated and the cause remanded for resentencing.
