This is a personal injury action in which Plaintiff William Christopher Womack ("Womack") alleges that he was injured in a railroad accident that occurred during the scope of his employment with Defendant Rail Link, Inc. ("Rail Link"). Before the Court now is Rail Link's Motion to Dismiss Plaintiffs' Complaint for failure to state a claim on which relief may be granted.1
