Defendant attended a required in-patient drug alcohol program as the result of his conviction for driving while intoxicated. There he met Thomas Rodruguez, Lorene Brown and Adrienne Reese, who were also in the program. Defendant occupied a second-floor apartment at his mother's house at the time, and when Rodruguez left the program defendant permitted him to stay in the apartment.
