GARRARD, Judge.
This case involves an Indiana city's annexation of land. Landowners of the annexed property sought to remonstrate against the annexation (Count I) and to seek a declaratory judgment that the annexation ordinance was void, illegal, invalid and of no force and effect (Count II).
