We granted certiorari in this case to consider whether, when parties agree during the course of litigation to submit their claims to binding arbitration, they waive the right to a jury trial. Even though the litigants in this case expressly agreed to submit all of their claims to binding arbitration, the Court of Appeals held that the right to a jury trial was not waived because the procedures followed in that arbitration rendered it non-binding.
