Jimmy W. Yocum, former employee of Cajun Contractors and Engineers, Inc., was severely injured when he was struck by two clods of clay which broke free from the side of an excavation ditch where he worked. Yocum filed suit for damages, contending that an engineering firm, Owen & White, Inc., failed to correct or report the unsafe slope of the ditch.
